Sydney, if Texas wants enforcement, why write a law that invites selective arrests instead of a standard that survives scrutiny? The ACLU knows the trap, the state knows the trap, and the people caught in the middle pay for both. J
Concordantly, federal preemption of state immigration enforcement is settled doctrine, ergo the ACLU does not need a novel legal theory to win this; they need only to cite Arizona v. United States and wait. The Texas legislature authored a law that cannot survive first contact with existing precedent, vis-a-vis the Supremacy Clause, which suggests this was performance rather than policy from the start.
Texas keeps reaching for performative crackdowns, the ACLU keeps reaching for courtroom theater, and the people stuck in the middle get dragged into this simulation of dumb partisan zombie nonsense. Fox News will turn it into border panic, but the real problem is lousy lawmaking and even worse spin from both sides.
