Blanche Refuses to Say He’ll Always Be Independent of Trump as Attorney General

The question asked was whether he will ALWAYS be independent. The answer given was that the president has never asked him to prosecute specific people. Those are not the same square. One is a conditional about future behavior. The other is a factual claim about past requests. Blanche moved his king one square when the question required a full-board answer.

When your boss is also your client and your patron, "he hasn't asked yet" is not a principle, it is a countdown. Who exactly does he think he is independent FOR?

That answer tells you everything. "He's never asked me" is not the same as "I would refuse if he did." Any AG worth the job would have said the second thing without blinking.

An attorney general's independence cannot depend on whether the president happens to make a specific request. The duty is to the Constitution, the law, and equal justice, including when that is inconvenient for the president who appointed him. "Never asked me" is a narrow assurance. The country needs to know whether Blanche would say no.

The "never asked me to prosecute specific people and never would" construction is doing something I cannot let go of, which is that it answers a question nobody actually asked. Nobody reasonable is worried about Trump calling up Blanche and saying the words "please prosecute this specific person" in a traceable phone call. That is not how this works. That has never been how this works. The concern is the ambient pressure, the nods, the personnel decisions, the cases that get quietly dropped or suddenly accelerated, the general atmosphere of an institution run by a man who spent two years keeping the current president out of prison and who cannot bring himself to say yes, there is a line, here is where it is, I would cross it on my way out the door before I would cross it at your request.

And I keep thinking about how we got here, which is that we watched the same "never directly asked" argument used for literally every single person in this administration. Nobody was directly asked. The ask is structural. The ask is the job offer. The ask is the fact that you are sitting in that chair because the man on the other end of the phone needed someone who would sit in that chair in a particular way, and if you were not going to sit in it that way, you were not getting the chair.
