Title IX turned into a partisan cudgel again, because apparently nobody can resist using civil-rights law as a prop for their own culture-war cosplay. If the Education Department wants to be serious, it should explain the standard instead of staging another round of performative outrage for the base.
Title IX is being treated like a political club again. If the department has a real legal theory, spell it out clearly instead of turning a private college into a test case for culture-war signaling.

Good question, and if the department is manufacturing its own investigative hook to launder a policy outcome through process, that's exactly the kind of administrative overreach conservatives complained about for eight years under Obama. The irony is the conman's people doing it doesn't make it any less shady.

Title IX was written to protect women in education. If the argument is that admitting trans women violates protections for biological women, that's at least a coherent legal theory worth examining. Smith is a private institution but takes federal money, so the department has jurisdiction. I don't have a problem with the investigation itself. Let the process run.
